PlayQuest Terms of Use
These Terms of Use (“Terms”) set forth the conditions for using “PlayQuest” (the “Service”) provided by Cresc LLC. (“the Company”). By using the Service, users (“Users”) agree to be bound by these Terms.
Article 1: Scope and Eligibility
- These Terms apply to all matters relating to the use of the Service between the User and the Company. Separate terms or rules (“Supplementary Rules”) may apply to specific features or events. In case of conflict, the Supplementary Rules shall prevail.
- Users must be 13 years or older to use PlayQuest.
- Users under 18 must have parental or legal guardian consent.
Article 2: Account Registration
- Users must provide accurate registration information and maintain account security.
- The Company may deny or revoke registration if:
- False or incomplete information is provided.
- The applicant is under legal incapacity without proper consent.
- The applicant has previously violated these Terms.
- The Company otherwise deems registration inappropriate.
- Users are responsible for managing their account credentials. The Company shall not be liable for damage caused by misuse or unauthorized use. Users must promptly notify the Company of any suspected misuse.
- The Company may suspend or terminate accounts for violations, suspicious activity, or maintenance reasons.
Article 3: Fees and Payment
- Some features or items within the Service may require payment. Pricing, payment methods, and billing cycles are determined separately by the Company.
- Payments are non-refundable except where required by law or explicitly stated by the Company.
Article 4: User Conduct
- Users must comply with applicable laws and regulations.
- Users may not post or share illegal, harmful, or infringing content.
- Users may not harass, threaten, or defame other users or third parties.
- Users may not interfere with or disrupt the Service or its systems.
- Users may not impersonate the Company or another person.
- Users may not promote religious, political, or ideological messages.
- Users may not collect personal information without consent.
- Users must not engage in any other conduct the Company deems inappropriate or damaging to the Service.
Article 5: Content Ownership and License
Users retain ownership of content they create or post. By posting content, Users grant PlayQuest a non-exclusive, worldwide, royalty-free license to display, distribute, and promote such content within the Service. PlayQuest may remove content that violates these Terms or third-party rights.
All intellectual property rights in the Service (including systems, design, and software) belong to the Company or its licensors. Use of the Service does not grant Users ownership or rights beyond those explicitly stated.
Article 6: Rewards and Quests
- Rewards or items earned through quests are subject to these Terms and may be revoked for violations.
- PlayQuest may modify, suspend, or cancel quests or rewards at any time without notice.
Article 7: Third-Party Services
PlayQuest may integrate or link to third-party services. Users must comply with those services’ terms. The Company is not responsible for third-party content, actions, or failures.
Article 8: Withdrawal
Users may delete their account through the method specified by the Company. Even after withdrawal, the Company may retain usage records and data for a reasonable period in accordance with its Privacy Policy and legal obligations.
Article 9: Disclaimer and Limitation of Liability
- The Service is provided “as-is” and “as available” without warranties of any kind.
- The Company shall not be liable for indirect, incidental, or consequential damages, including:
- Service interruptions or errors
- Unauthorized access or data breaches
- Disputes between users or third parties
- If the Company is held liable for any reason, its total liability shall not exceed the total amount paid by the User to the Company in the past twelve (12) months.
Article 10: Handling of Personal Information
The Company handles Users’ personal information in accordance with its Privacy Policy. By using the Service, Users agree to such handling.
Article 11: Copyright Infringement (DMCA)
PlayQuest respects intellectual property rights and responds to DMCA notices. Users may report copyright infringement by emailing hi@playquest.com with the following information:
- Your physical or electronic signature
- Description of the copyrighted work
- Location of the infringing material on PlayQuest
- Your contact information (address, phone, email)
- Statement of good faith belief that use is unauthorized
- Acknowledgment of potential liability for misrepresentation
If your content is removed by mistake, you may submit a counter-notification including your signature, content identification, contact information, and consent to jurisdiction. Misrepresentation may result in legal liability.
Article 12: Notices and Assignment
- Communications from the Company to the User shall be made via the Service interface or email, and shall be deemed delivered when sent.
- Users may not assign, transfer, or pledge their rights or obligations under these Terms without prior written consent of the Company.
Article 13: Anti-Social Forces
Users represent and warrant that they are not and will not be affiliated with organized crime groups or other anti-social forces. If this representation is violated, the Company may immediately terminate access to the Service without compensation.
Article 14: Changes to Terms
The Company may modify these Terms at any time. Significant changes will be notified in advance through the Service. Continued use after changes constitutes acceptance.
Article 15: Governing Law and Jurisdiction
- These Terms are governed by the laws of Japan.
- Disputes are subject to the exclusive jurisdiction of the Tokyo District Court.
